Distance sales contract for services purchased electronically through Altın Atlas.

This Distance Sales Contract ("Contract") is concluded between the Seller/Supplier whose information is stated below and the Buyer/Consumer who places an order electronically through www.altinatlas.com.

1.2. Buyer / Consumer Information The buyer's name-surname/trade name, email address, phone number, billing and payment information consist of the information declared in the system during the creation of the order.

The subject of this Contract is the provision of the online inventory test access purchased by the Buyer electronically through the Site and the digital report to be prepared according to the test results, and the determination of the rights and obligations of the parties.
4.1. The Seller provides a single-use digital test access and digital report service created based on test results through the website www.altinatlas.com. The services are provided in accordance with the content, scope and price information announced on the Site at the time of purchase.
4.2. The test services offered through the Site are as follows:
a) Academic Inventory Test The Academic Inventory Test is a digital inventory test designed to assess the user's academic tendencies, learning approach, study habits, academic compatibility and educational orientation. After completing the test, the user obtains a personal assessment report based on the answers given. Fee: The test types and current sales prices are valid as announced on the Site at the time of ordering.
b) Advanced Academic Inventory Test The Advanced Academic Inventory Test is a digital inventory test designed to evaluate the user's advanced academic competencies, academic preparedness, capacity for disciplined work, and research and development orientation. After completion, the user obtains a personal assessment report based on the answers given. Fee: The test types and current sales prices are valid as announced on the Site at the time of ordering.
c) Corporate Career Inventory Test The Corporate Career Inventory Test is a digital inventory test designed to assess the user's general employment suitability, work discipline, adaptation to work life, approach to duties and professional tendencies. After the test is completed, the user obtains a personal assessment report based on the answers given. Fee: The test types and current sales prices are valid as announced on the Site at the time of ordering.
4.3. The services specified above are based on one-time purchases. Each purchase is valid only for the relevant test and does not have the nature of a subscription, automatic renewal or timed membership.
4.4. Each test purchase is valid for only one user. The test access purchased cannot be transferred, used, shared or resold for commercial purposes to another person.
4.5. After the purchase, the user obtains access to the relevant test. After the test is completed, the digital report created based on the answers given by the user is delivered to the user electronically or made accessible via the user account within a maximum of 3 (three) days.
4.6. The fees for the tests are clearly shown on the payment page and in the order summary. The Seller reserves the right to change test fees; however, price changes apply only to new orders after the change. The price approved by the Buyer at the time of payment is taken as basis for the relevant order.
4.7. If periodic campaigns, discounts, promotions or special price applications are made on the Site, the relevant conditions apply only within the period and scope specified.
4.8. The reports provided under the purchased service are for information, evaluation and guidance purposes only. These reports do not constitute any official certificate, state-approved document, medical diagnosis, psychiatric evaluation or clinical report.
5.1. The Buyer examines the essential qualities of the selected service, the sale price, payment conditions and other preliminary information on the Site and creates the order by confirming it electronically.
5.2. The service fee is the amount specified on the Site during the order. The sale price may be charged in Turkish Lira (TL) or US Dollars (USD), depending on the nature of the service.
5.3. Upon successful completion of the payment transaction, this Contract is deemed to be established and the performance of the service begins.
5.4. The process of issuing an invoice/e-archive/e-invoice is fulfilled according to the Seller's obligations under the current tax legislation.
6.1. The service under this contract does not include physical delivery; it is performed entirely in digital environment.
6.2. Test access is provided immediately after payment approval.
6.3. The report regarding the test is prepared after the test is completed and delivered to the Buyer in electronic environment.
6.4. Access to the report may be provided via e-mail, user panel or other digital methods deemed appropriate by the Seller.
6.5. If there is a delay in the report delivery process due to technical infrastructure, system security, intensity, review needs or force majeure, the Seller informs the Buyer within a reasonable time.
Although consumers generally have a 14-day right of withdrawal in distance contracts, exceptions may apply for some services that are performed instantly in electronic environment and intangible goods delivered instantly to the consumer. These exceptions are clearly stated in official consumer guides.
7.1. The Buyer may request a withdrawal/refund provided that he has not started the test.
7.2. Withdrawal/refund requests should be transmitted to support@altinatlas.com in writing or via a durable data storage. The official consumer information of the Ministry of Commerce also emphasizes the importance of making withdrawal notifications in writing or via durable data storage.
7.3. The Buyer accepts that access to the test will be opened immediately after payment and the performance of the service will start immediately.
7.4. If the test has been started, access has been opened in the system, answer input has been made or the test process has actually started to be used, refund requests are evaluated according to the characteristics of the case, taking into account that it is a digital service whose performance has started.
7.5. If the test has been completed and the report process has started, as a rule, the report is re-processed, corrected or re-delivered first; direct refund is not mandatory.
7.6. If the report has been delivered to, viewed or downloaded by the Buyer, refund requests are separately evaluated by the Seller, as the essential part of the service is deemed to have been performed.
7.7. In the event of a technical error, system failure, access problem or similar problem originating from the Seller, the following ways are primarily applied:
If these solutions are objectively not possible or are not accepted for justified reasons by the Buyer, refund may be considered.
7.8. If a refund is deemed appropriate, the amount is refunded to the Buyer within the legal period, depending on the payment instrument and the processes of the relevant payment organization.
8.1. The Buyer accepts that he has read and been informed about the preliminary information on the Site, has electronically approved the basic features of the service, the price, payment conditions and the provisions of this Contract.
8.2. The Buyer accepts that the service is purchased only for his own personal use; he will not share his account, test access and report with third persons in a commercial or misleading manner.
8.3. The Buyer accepts that the information provided during the test is correct and belongs to him, and that he is responsible for the consequences of providing incorrect/incomplete information.
8.4. The Buyer accepts that the purchased service does not have the purpose of diagnosis, psychiatric, medical or clinical evaluation, and is not an official certificate or state-approved document.
8.5. The Buyer accepts that the test result and the report are only for information, evaluation and guidance purposes, and that the final decision and application responsibility belongs to him.
9.1. The Seller is obliged to provide the digital service subject to this contract in accordance with the qualities specified on the Site.
9.2. The Seller tries to take the necessary technical and administrative measures to provide test access and deliver the report within a reasonable/announced period.
9.3. The Seller may provide the necessary information in the event of a temporary interruption of the service due to technical maintenance, software update, security reasons, intensity, force majeure or reasons arising from third-party infrastructures.
9.4. The Seller reserves the right to suspend or terminate the service in case of misuse, account sharing, misleading use on behalf of third parties, system manipulation or behavior contrary to the contract.
10.1. All intellectual and industrial rights on the test content, questions, system structure, assessment logic, report format, designs, writings, visuals and all other elements belong to the Seller or the relevant right holders.
10.2. The Buyer cannot copy, reproduce, use for commercial purposes, license to third parties or publish test contents, the report, system outputs or any content on the Site.
11.1. Personal data belonging to the Buyer are processed in accordance with the applicable legislation.
11.2. The details regarding the processing of personal data are arranged in the KVKK Clarification Text and other policies/texts published on the Site. The KVKK Authority clearly states that the disclosure obligation is an independent obligation that must be fulfilled in all cases separately from explicit consent.
The parties cannot be held responsible for temporary or permanent inability to fulfill the obligations arising from the contract due to force majeure such as natural disaster, war, terrorism, epidemic, infrastructure collapse, internet/electricity interruption, cyber-attack, decisions of official authorities or similar.
The parties accept that, in disputes that may arise from this Contract, the Seller's commercial books and records, database records, log records, electronic correspondence, payment records and system records are evidence within the framework of the applicable legislation.
14.1. The Buyer may submit complaints and requests to support@altinatlas.com.
14.2. In disputes arising from this Contract, Consumer Arbitration Committees and Consumer Courts in accordance with the monetary limits in force on the date of application are authorized. This authority and duty system is applied within the framework of Law No. 6502.
15.1. The Buyer declares that he has read, understood and accepted all the provisions at the moment he completes the order on the Site and electronically approves this Contract.
15.2. This Contract enters into force on the date it is approved electronically.
